Most privacy policies are written to be skimmed and forgotten. We wrote this one to be read. It explains, in plain terms, what information we collect through our website, why we collect it, and the choices you have.

1. Who we are

Konstruct, Inc. (“Konstruct,” “we,” “us”) is a digital marketing and technology agency headquartered in Atlanta, Georgia. We serve business clients — healthcare practices and other organizations — and this website exists to describe our services and let prospective clients, partners, and candidates reach us.

2. What this policy covers

This policy applies to konstruct.agency (the “Site”) and to information you share with us directly in the course of business communication — for example, when you submit our contact form, email us, or apply for a role.

It does not cover:

  • Work we perform for clients. When Konstruct provides services to a client — building a website, managing campaigns, analyzing data — we handle information on that client’s behalf under written agreements that govern its use and protection. Where that work involves protected health information, it is performed under HIPAA business associate agreements. Those contracts, not this policy, control how client data is handled.
  • Client websites. Websites we build or manage for clients have their own privacy practices and their own policies.
  • Third-party sites. Links from our Site to other websites are governed by those sites’ policies.

3. A note about health information

Konstruct is a marketing and technology agency, not a healthcare provider. This Site is intended for business inquiries only.

Please do not submit health information through this Site — including symptoms, conditions, treatments, appointment details, or any information about your care. If you are a patient of one of our clients, contact your provider directly; we cannot access records, schedule appointments, or answer patient questions.

If health information is inadvertently submitted through our forms, we delete it promptly upon discovery.

4. Information we collect

Information you provide:

  • Contact and inquiry details — name, email address, phone number, organization, and the contents of your message when you use our contact form, email us, or call.
  • Business communications — information exchanged in the ordinary course of discussing or providing our services.
  • Job applications — résumés, work history, and related materials sent to careers@konstruct.agency.

Information collected automatically:

When you visit the Site, we and our service providers collect standard technical data — IP address, browser and device type, operating system, referring pages, pages viewed, and timestamps — through cookies, server logs, and similar technologies described below.

We do not ask for, and request that you not send, government identifiers, financial account details, or other sensitive personal information through the Site.

5. How we use information

We use the information described above to:

  • Respond to inquiries and communicate about our services
  • Operate, secure, and improve the Site
  • Understand how the Site is used, in aggregate
  • Send communications you have requested, which you can opt out of at any time
  • Evaluate job applications
  • Detect and prevent fraud, abuse, and security incidents
  • Comply with legal obligations and enforce our agreements

We do not sell personal information. We do not share personal information with third parties for their own marketing, and we do not use cross-context behavioral advertising on this Site.

6. Cookies and analytics

The Site uses a small number of cookies and similar technologies:

  • Essential cookies, required for the Site to function and remain secure.
  • Analytics cookies, which help us understand Site usage in aggregate. We use Google Analytics 4 for measurement, not advertising.

Where consent is required, we ask before setting non-essential cookies. You can also control cookies through your browser settings, and Google offers a browser add-on that blocks Google Analytics. We honor Global Privacy Control signals where applicable law requires.

7. How we share information

We share personal information only in limited circumstances:

  • Service providers that support our operations — website hosting, analytics, email and customer-relationship tools, scheduling, and similar functions — under agreements limiting their use of the information to services performed for us.
  • Professional advisors — lawyers, accountants, and insurers — where reasonably necessary.
  • Legal requirements — when disclosure is required by law, subpoena, or valid legal process, or to protect the rights, safety, or property of Konstruct or others.
  • Business transitions — if Konstruct is involved in a merger, acquisition, or sale of assets, personal information may transfer as part of that transaction, subject to this policy’s commitments.
  • At your direction — where you ask us to share information on your behalf.

8. Data retention

We keep personal information for as long as reasonably necessary for the purposes described in this policy: responding to your inquiry, maintaining a business relationship, meeting legal and accounting obligations, and then delete or de-identify it. Application materials may be retained for consideration for future roles unless you ask us to delete them.

9. Security

We use commercially reasonable safeguards to protect personal information, including encrypted connections (TLS), access controls, and reputable infrastructure providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security — but we design and operate with care, and we limit what we collect in the first place.

10. Your privacy rights and choices

Email preferences. Marketing emails include an unsubscribe link, and you can opt out at any time by contacting us. We will still send transactional messages related to an active inquiry or engagement.

Access, correction, and deletion. A growing number of US states grant residents rights to access, correct, delete, and obtain a copy of their personal information. Konstruct honors these requests from any US resident, regardless of whether a particular statute technically applies to us. To exercise them, contact privacy@konstruct.agency. We will verify your request — typically by confirming control of the email address associated with the information — respond within the time required by applicable law and in any case within 45 days, and we will not discriminate against you for exercising your rights.

If we decline a request, you may appeal by replying to our decision; we will review the appeal and respond as applicable law requires. You may also contact your state attorney general.

11. Children

The Site is intended for business audiences and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us and we will delete it.

12. Visitors outside the United States

Konstruct operates from the United States, and our Site and services are directed to US audiences. Information you provide is processed and stored in the United States, where privacy laws may differ from those of your jurisdiction. By using the Site, you understand that your information will be transferred to and processed in the US.

13. Changes to this policy

We may update this policy from time to time. When we do, we will revise the effective date above and post the updated version on this page. For material changes, we will provide more prominent notice on the Site.
